Sub: Redemption of land mortgaged by the local Land Lords with muslim evacuees.
Memorandum:
For some time past, it has been noticed that no uniform procedure is being followed in the matter of recovery of mortgage debt by our Assistant Custodian from the local land owners who had mortgaged their lands with the muslim evacuees and to whom equity of redemption still subsisted. Some cases in which local mortgagors had applied for the redemption of the land within a period of thirty years, but their cases remained undediced for one reason or other, are reported to have been rejected on the ground that the mortgaors had failed to pay the mortgage amount within the limitation period of thirty years. It is now clarified that where a mortgagor has filed an application for redemption of the land within limitation, his case should be processed according to the law, heedless of the fact whether or not he has made payment of the mortgage debt within the period of limitation. In such cases the mortgage debt should be recovered within a period of thirty days from the date, the redemption order is passed by an Assistant Custodian.
