Sub : Transfer of Rural Evacuee Houses
From time to time, the Punjab Government have been extending the date of receipt of Rural Houses Sites applications from the occupants of surplus rural evacuee houses and sites for the transfer thereof at reserve/ concessional price. The last extension in this behalf expired on 31- 7-1968. Still a very large number of the occupants of these properties have not made applications. It has now been decided to give a final opportunity to the occupants of the aforesaid properties to make applications by October 31, 1970 at the latest, for the transfer of these properties. The Government have also made the following relaxation in the extant policy of transfer of rural evacuee houses/sites :
(i)the date of possession has been advanced from 31-12-1965 to 31-12- 1969.
(ii) the occupants who have been in continuos possession of rural evacuee houses and sites since 31-12-1969 will now be eligible for the transfer of the same on reserve/concessional price, as the case may be ;
(iii) the condition of construction in respect of Taurs has been totally eliminated
(iv) the taurs which are in un-disputed possession of the occupants will now be transferable to them regardless of the fact whether or nor they have raised any construction thereon. Constant use of a taur in any form by an occupants would be the determining factor of possession. Where the possession is disputed, the taur would be sold by public auction.
(2) All occupants of surplus rural evacuee houses and sites who have not yet, got the same transferred in their names should now make applications to the Tehsildar (Sales) /Naib Tehsildar (Sales) concerned by October 31,1970 positively. No further extension in the date would be given under any circumstances. The Tehsildars (Sales)/ Naib Tehsildar (Sales) have, however been authorized to entertain such applications even at the spot. In that case a non-Harijan occupant would be required to pay the penalty of 50% of the reserve price of the house/taur in his possession while the Harijan occupant would be required to pay a similar penalty to the extension of 50% of the reserve price subject to maximum of Rs. 50/-.
There may be quite to a few cases of land allottees, occupying rural evacuee houses and taurs which were not regularly allotted to them as appurtenant to their land allotments. But they are occupying the some as if these are allotted to them as such. There may also be some cases in which the land allottees have lost their allotment orders and taurs allotted to them These categories of persons have also been permitted to (got their allotment regularized by the Tehsildar (Sales)/Naib Tehsildar (Sales) concerned by making applications before October 31, 1970. In case they fail to do so, the properties in their possession will be disposed of by auction.
