Press Note – Transfer of urban evacuee houses/shops/commercial site to occupants who are in possession since 1/1/1970

All urban evacuee properties in Punjab are henceforth to be disposed of by the Rehabilitation Department of the Punjab Government on behalf of the Government of India. Although the authorized occupants, whether claim holders or non claimants, are entitled to get the propereis in their occupation transferred by negotiation under Rules 25 and 26 of the Displaced Persons (Compensation & Rehabilitation) Rules 1955, yet in order to avoid dislocation of the unauthorized occupants or evacuee properties, it has been decided to transfer the properties in their possession by negotiation under Rule 87-88 of the said Rules, on the prescribed conditions, provided such occupants apply for the transfer of the properties in their possession within three months of the date of issue of this press note. The main features of the scheme of transfer of properties to unauthorized occupants are given below :

(1) Evacuee Houses/shops/commercial sites etc. and building plots on which construction has already been raised will be transferred to the unauthorized occupants, whether displaced or non displaced, on current market price, provided their possession is continuous and undisputed from 1/1/1970 or before and provided that in the case of building plot, the construction had been raised on or before the said date. The transfer will be subject to the conditions prescribed by Govt.

(2)Urban evacuee agricultural land encroached upon and utilised for construction of residential/ commercial building(s) will also be transferred to the unauthorized occupants at the current market price subject to the other prescribed conditions ;

(3)If an unauthorized occupant is declared eligible to the transfer of the property in his possession, he will have to pay 30% of the market value, rent and other dues if any, in respect of the said property, in cash within 30 days of the determination of his eligibility, while the balance will be recovered in two half yearly instalments with interest at the prescribed rate. No claims or statements of Account would be accepted.

(4)In case of occupants belonging to Scheduled Castes, the following further concessions will be allowed, if eligibility for transfer is declared .

(i)Properties will be transferred to them at 50% of the market price payable by non scheduled caste occupants.

(ii) The price will be paid by them in eight instalments, the first of which will be paid on sale alongwith rent and other dues, and the remaining seven in half yearly interest free instalments.

(iii)Where it is established that members ofScheduled Castes had built houses on the evacuee land i.e. (land owned by Muslim migrants) before 15th August 1947 , such persons shall be entitled to retain those houses without any further payment.

(iv)All urban evacuee agricultural lands/ properties not covered in the above items will be sold by public auction or by inviting tenders, under the provisions of the Displaced Person (Compensation & Rehabilitation) Act and Rules framed thereunder :

2. All interested persons are advised to submit their applications (in duplicate) for transfer of properties in their possession to the Assistant Settlement Officer (Sales), 965-Model Town, Jalandhar within three months from the date of issue of this Press Note. The applications should contain all the relevant information and should be accompanied by an affidavit verifying the facts given in the application and a postal order of Rs.1/-. It may be made clear that unauthorized occupants, who have already applied for the transfer of properties in their occupation to the said officer, need not apply afresh.
