Sub:     Modification in the policy with regard to disposal of rural agricultural lands which have subsequently become sub urban.

 

Memorandum:

           

            The Government have decided that surplus rural agricultural evacuee land, which had become sub urban after Rabi 1976 on account of extension of municipal limits of the adjoining Towns may be allowed to be transferred to the occupants, who had undisputed cultivating possession since Rabi 1978 upto 3 ordinary acres, inclusive of their own holdings, if any, provided the occupants had applied for transfer on or before 31st October, 1980. The price in respect of such lands may be charged from the non-scheduled castes occupants at the current market rate and from scheduled castes occupants at 75% of the said market rate in 20 equated half yearly instalments. The instalments may be interest free in the case of scheduled castes occupants whereas interest at the rate of 10% per annum on the outstanding amount in the case of non-scheduled castes occupants may be levied. Similarly, it has also been decided that the occupants of urban houses/taurs situated in the villages, which have become urban after 1/1/1977 and who had applied for its transfer upto July 31, 1979, may be transferred. The properties in their possession at the same price as applicable to rural properties, if they fulfil the conditions about continuous and undisputed possession since 1/1/1977. This concession should be limited to such applicants only who had applied by 31st July, 1979 and in these cases, no delayed applications should be entertained on payment of penalty.

2.         Necessary amendment in the Punjab Package Deal Properties (Disposal) Rules, 1976 has already been made vide Notification dated 8th May 1986 published in the Punjab Government Gazette on May 16, 1986 copy of which is enclosed for ready reference. Advertisement in this behalf is also being issued for publication in the Newspapers and a copy thereof is also sent herewith for guidance.

3.         This work should now be taken in hand at once and all the applications decided strictly in accordance with the rules and instructions. The progress report in this behalf may also be sent to this department by 10th of every month.
