Application for allotment of land in lieu of the land abandoned in Pakistan by Sh. Sohan Singh son of Ballaqi Singh.

This is an application filed by Harbhajan Singh, Ajaib Singh sons of Late Sh. Sohan Singh village Behna Buland P.O. Nurpur District Fatehgarh Sahib. In this petitioners have mentioned that they were allotted land to the tune of 14 Kanal 16 Marla, Khasra No.3488 in village Kamalpur (Mothanwala) Tehsil and District Kapurthala in the name of their father Sh. Sohan Singh son of Ballaqi Singh in lieu of the land abandoned by their forefathers in Pakistan. They are running from pillar to post to get Nishan Dehi and possession of the land. Therefore, they requested that the said land be got restored to them.
The petitioner was presented on 25.9.2000 and he was directed to produce copy of Jamabandi Pakistan, proof of legal heirs of the allottee and a copy of Parchi allotment and next peshi was fixed for 11.12.2000 but the petitioner did not appear on 11.11.2000. Again a notice was sent to the petitioner for 16.4.2001.
Today petitioner has come present. He has produced a copy of Mutation dated 29.7.65 sanctioned on 30.7.65 relating to village Kamalpur Tehsil Sultan Pur Lodhi. As per entries in this mutation land measuring 10 Kanal 17 Marla comprised of Khasra Nos.92(1-12), 18/3 (1-8)12/2 (2-12), 13/1 (2-8), 18/1 (2-17) Sohan Singh ½ share & Kirpal Singh Budh Singh ½ share and above persons had 3/16 share in Khasra No.92//26 (1-5). All the above area was sold to Gian Singh son of Dhanna Singh vide sale deed executed during July, 1965. Sh. Harbhajan Singh has today given a new twist to his case by orally claiming that this sale deed was got executed from them when they were minor. So the sale deed be cancelled & land be restored to them.
The contention of the petitioner is totally ill conceived before me. Such type of contentions can be raised only in Civil suits. If the petitioners had any grudge against the alleged sale deed they could have secured relief in Civil Suit. The Rehabilitation Department has nothing to do with the present case.
Hence the application is filed.
