Sub: Entertainment of applications for redemption of lands of local owners who had mortgaged their lands with Muslims before partition.
Memorandum
As you are aware, under the provisions of Section 6(3) of the Evacuee Interest (Separation) Act 1951 no application under this Section is to be entertained if filed after the expiry of one year from the commencement of the Evacuee Interest (Separation) Amendment Act 1960. It has come to the notice of this department that you are entertaining applications from local land owners even until now, which would only be made upto 15/10/1961 and on the basis of these applications, lodging information with the State Competent Officer for separating the evacuee and non-evacuee interest, absolutely in contravention of the provisions of law, referred to above. The matter has been considered threadbare and it has been decided that in future, you, in exercise of your powers as Assistant Custodian, should refer only those cases in which interest of the Government is involved. It is further pointed out that a final order, in this behalf is to be passed by the Custodian General and not by you. You are, therefore, desired to stop the existing procedur3e forthwith and to refer only those cases to the State Competent Officer, Punjab, wherein the interest of the Government alone is involved and thereafter to submit the same to the Custodian General, for passing final orders therein.
