ITEM NO. 28.1 CONFIRMATION OF THE MINUTES OF THE 27TH MEETING OF THE STATE LEVEL COMMITTEE HELD ON 14/2/2001

Minutes of the 28th meeting of the State Level Committee for calamity relief fund held on 14/2/2001 as circula1ed to all 1the members were confirmed.

ITEM NO. 28.2 ACTION TAKEN REPORT ON THE DPROCEEDINGS OF THE 27TH MEETING OF THE STATE LEVEL COMMITTEE HELD ON 14/2/2001

26.5 Completion of Mehmoodpur drain in tehsil Balachaur district Nawanshehar :

Secretary Irrigation stated that the work had been started and could be completed by 15/6/2001.

26.6 INVESTMENT BY CALAMITY RELIEF FUFND WITH THE SBI

(a) Deputy Secretary Revenue (Administration) who had been authorized to sign it is being sent to Mumbai for signing the application and filing it before the Mumbai High Court. This will be done by 30/4/2001.

(b) The draft has been vetted by the Director Prosecution and notice would be sent to State Bank of India within a week.

26.7 UTILIZATION CERTIFICATE FOR THE FUND RELEASED TO IRRIGATION DEPARTMENT DURING THE YEAR 1999-2000

It was decided in The 26th meeting held on 8/12/2000 that Irrigation Department in consultation with the Finance Department would prepare a uniform proforma for utilization certificates. This item was also reviewed in the 27th meeting held on 14/2/2001 and the Utilization Certificates in the revised proforma were to be submitted by 20/3/2001. The Secretary, Irrigation stated that the revised proforma has not been prepared. The Chief Secretary regretted the delay in finalization of the proforma and the submission of utilization certificates. It was decided that Secretary, Irrigation would call Deputy Secretary Administration of the Revenue Department and OSD Sh DP Karkara in the Finance Department and have the proforma prepared within a week’s time. The utilization certificates thereafter would be submitted within 2 week’s time i.e. the utilization certificates in the revised proforma amounting to Rs. 14 crore would be submitted by 10/5/2001.

ITEM NO. 28.3 NATIONAL CALAMITY CONTINGENCY SCHEME 2000-05

The salient points of The National Calamity Contingency Scheme were explained and noted by all the members for information.

ITEM NO. 28.4 QUORUM OF THE COMMITTEE

The addition of Secretary, Public Health Department as member of the State Level Committee for Calamity Relief Fund was noted. It was decided that 5 members would constitute the quorum for the meetings of committee.

ITEM 28.5 GRANT OF RELIEF DUE TO DAMAGE TO CROPS, HOUSES AND LOSS OF LIFE ETC

The Financial Commissioner, Revenue explained that the crop loss during the year 1998-99 was on account of late rains in October 1998 when the paddy had arrived in the grain markets. It was not possible to assess the damage and at the requests of Government of Punjab, the Government of India relaxed the specification for procurement of paddy, which resulted in benefit to the extent of Rs. 22 to 30 per quintal to the farmers. The members felt that it was not possible to ascertain and verify the crop loss for years prior to 1999-2000 and since this matter has been discussed in detail in the last meeting and in the meeting under the chairmanship of Chief Minister on 18/3/2001, only the crop loss in the last 2 years i.e. for the years 1999-2000 and 2000-01 be sanctioned. The committee accordingly granted its approval to the following cases of crop loss :

All other cases i.e. (17 cases amounting to Rs. 4.89 crore) cases of crop loss from 1995-96 to 1998-99 and all cases of house damage and loss of livestock , the list of which is placed at Annexure-IV were rejected.

ITEM NO. 28.6 RELEASE OF FUNDS FOR FLOOD PROTECTION WORKS

(1)The committee approved the list of works amounting to Rs. 14.99 crore. A sum of Rs. 7.46 crore was released on 5/3/2001 as per the decision in the 27th meeting held on 14/2/2001. The committee approved the release of remaining amount of Rs. 7.53 crore to the Irrigation Department. The district wise allocation will be as follows:

(2)The Secretary, Irrigation assured that these works would be completed by 15/6/2001 well before the start of monsoon season. This would give sufficient time to the Deputy Commissioner and other officers to check and inspect the quality of work.

It was decided in the 27th meeting held on 14/2/2001 that the Irrigation Department would issue a specific guidelines to the Deputy Commissioners that they would inspect each and every work atleast once during the execution. They would also inspect the works after completion and record their observations about the quality of works and utilization of funds. It was decided in the meeting that Irrigation Department would procure certificate from the Deputy Commissioner after 15/6/2001 about the completion of all the works and the satisfactory nature of execution.

ITEM NO.28. 7 ASSESMENT OF DAMAGE ON ACCOUNT OF FLOOD THROUGH SATELLITE

In addition to the 6 items discussed above, this item was taken up for discussion with the permission of Chairman. Secretary Revenue explained that the Regional Center of National Remote Sensing Agency at P AU Ludhiana was willing to undertake the work or assessment of crop damage on account of floods through satellite pictures, Before they could undertake this work, the village maps of all the districts have to be digitized. Once this is done the agency would be in a position to give assessment of crop loss on account of floods etc village wise. The scheme would cost between Rs. 10-15 lacs. The members felt that it was a good suggestion and the Secretary Revenue should work out the details with the National Remote Sensing Agency.

ITEM NO. 29.1 CONFIRMATION OF THE MINUTES OF THE 2STH MEETING OF THE STATE LEVEL COMMITTEE HELD ON 17/4/2001

The minutes of the 28th meeting of the State Level Committee for calamity relief fund held on 17/4/2001 as circulated to all the members were confirmed.

ITEM NO. 29.2 RELEASE of Rs. 571.75 LACS FOR FLOOD PROTECTION WORKS

(A) The Committee for calamity relief fund approved a sum of Rs. 7.46 crores for flood protection works in its meeting held on 14/2/2001. The funds were released on 5/3/200 I. Subsequently the second installment of Rs. 7. 53 crores was approved in the meeting held on 17/4/2001 and the money was released on 8/5/2001. The Deputy Commissioners apprised the committee that the Irrigation Department had not started the works. The DC Kapurthala pointed out that perhaps the contract for purchase of wire for grading has not been finalized. The Secretary Irrigation pointed out that the department had more or less completed all the formalities for starting the works and all the works would be started immediately and would be completed by 15/6/2001 or at the latest by 22/6/2001. She also pointed out that 3 firms were been given the rate contract for supplying the wire and their capacity was much less than the requirements of the department.

The committee regretted that the department has not taken adequate steps for completing the works in advance of the monsoon season. The Financial Commissioner, Revenue pointed out that the Revenue Department had been writing to the Irrigation Department for sending the prioritised lists of works duly approved by the District Level Flood Protection Committees, since November 2000. The list was not finalized till February 2001 and the committee for calamity relief fund felt that 50% of the required funds be released as advance so as to enable the department to complete initial formalities for starting the works. No progress was shown by the department and the work have not been started in all the districts even now.

After a detailed discussion, it was decided that:

(a) The Irrigation Department would start the works immediately and send a copy of the works order alongwith schedule of works to the respective Deputy Commissioners.

(b) All the works would be completed by 15/6/2001 and in any case by 22/6/2001. Secretary Irrigation assured that the works would be completed as per schedule by 15/6/2001.

(c) The works will be inspected atleast twice by the Deputy Commissioners during and after execution. The Irrigation Department would issue instructions in this regard to the Deputy Commissioners.

(d) The Deputy Commissioners would send a report on 1/6/2001 about the status of progress of the works and their observations about quality of work. This report will be sent to both Secretary Irrigation and Financial Commissioner Revenue.

(B) The matter regarding release of a sum of Rs. Rs. 5.11 crores to 8 districts was discussed in detail. DC Gurdaspur felt that the list needed be modified and some new works within the stipulated financial limits could be added for saving the abadis. DC Faridkot stated that only 2 works related to his district and remaining works of Rs. 26.50 lacs pertained to Mukatsar district. DC Hoshiarpur and representative of DC Amritsar stated that the list of new works was in order. ADC Ferozepur stated that DC was busy in connection with CM's visit and he would send the list of works after discussing the case with DC. The committee approved release of sum of Rs. 5.71 crores to the following 8 districts :

The release is subject to the following conditions :

(a) The DC Gurdaspur, Mukatsar and Ferozepur would finalize the list within the allocated amount and send it to Secretary, Irrigation and Financial Commissioner, Revenue in a day or so. The Department of Irrigation would start works immediately and complete them by 15/6/2001

(b) The Department of Irrigation would record a certificate that the sites identified are the most emergent and critical and with the execution of

proposed quantum of work, there is a reasonable assurance of meeting any emergency arising during the rainy season.

(c) All the works would be completed by 15/6/200 1 and no financial liability will be created above Rs. 5.71 crores.

ITEM NO. 29.3 GRANT OF RELIEF IN CASE OF LOSS OF LIFE / PROPERTY / CROPS DUE TO FIRE

As pointed out in the agenda note presently relief for loss of life / animals on account of fire is being given but relief in case of loss of property / crops on account of fire had been discontinued in 1997 by the State Level Committee as this provision was widely misused. Exceptional cases where damage I loss is extensive can always be considered by the committee on a case to case basis.

The DC Kapurthala briefed the committee about extensive loss caused to a Basti in Sultanpur Lodhi on 7 15/200 1 on account of fire. He stated that about 45 families have been affected and he released a sum of Rs. 40,000 for the affected families from the Red Cross. He suggested that the committee could release a sum of Rs. 1.50 lac to the district for providing relief upto Rs. 5000 per family. The families have incurred heavy loss and they have lost their dwelling units as well as all the household items. The proposal of DC Kapurthala was accepted and the con1ll1ittee decided to release a sum of Rs. 1.50 lac for the district, The DC could provide relief @ not exceeding Rs. 5000 per family and send the utilization certificate.

The proposal of DC Ferozepur for release of sum of Rs. 2.00 lac was also discussed, It has been reported by him that one person had lost his life due to fire. Besides there were cases of fire in a number of villages and the fodder stored by the farmers had been burnt. He has reported cases of fodder burning in as many as 24 villages. The committee felt that there was already provision for providing relief in case of loss of life due to fire and DC could send detailed proposal in tills regard to the Revenue Department J for release of funds. His proposal for compensating the farmers for the fodder burnt due to fire was found lacking in details. It was felt that it would not be appropriate to sanction relief for isolated cases of fire.

FCR pointed out that at present much of the time of Emergency Relief Branch is spent in handling isolate cases or loss to human and animal life and to property. Such cases are heavily delayed because or lack of formalities on the part of District Administration. The essence of calamity relief is timely aid to the affected persons. Entertainment of delayed cases not only leads to frustration but also leads to corruption and even generation of fake cases. Recently a campaign was carried out to dispose of old cases. It transpired that some of the claims for loss to life and property were pending for more than 4-5 years, these cases related to isolated and individual cases and even to migratory population. It was felt that normally loss reported after 2-3 days should be ignored. It may be more desirable to place some funds at the disposal of Deputy Commissioners to give prompt relief in unusual situations to eliminate delays associated with a highly complicated system. A proposal will be prepared by the Revenue Department for submission before the next meeting of Calamity Relief Fund.

AGENDA ITEM No. 30.1 CONFIRMATION OF THE MINUTES OF THE 29TH MEETING OF THE STATE LEVEL COMMITTEE HELD ON 15/5/2001.

The minutes of 29th meeting of the State Level Committee held on 15/5/2001 were confirmed.

AGENDA ITEM No. 30.2 PROVIDING RELIEF FOR CROP LOSS DUE TO FIRE

It was observed that though presently there are no general instructions covering loss due to fire there has never been any hesitation on the part of the Committee to approve relief in genuine deserving cases e.g. in case of Kapurthala when wide-spread devastating fire was reported by D.C. recently, the Committee unhesitantly decided to allow immediate relief at the rate of Rs. 5000 per family. The problem is in allowing belated claims, which are not supported by any site inspection and verifiable parameters.

It was decided that for crop loss due to fire relief @ Rs. 3000 per acre may be provided. The Revenue Department would issue detailed guidelines for inspection / verification of crop loss due to fire. The cases should be personally verified by the Circle Revenue Officers within a period of 48 hours. Norms and upper limits may also have to be laid down for loss to house and property (loss to Life and livestock stands already covered). Instructions would take effect from the date of issue. As regards the crop loss due to fire in the preceding Rabi crop i.e. Rabi 2001, the Revenue Department may separately ask the Deputy Commissioners to send cases where there has been extensive loss due to devastating fire.

AGENDA ITEM NO. 30.3 CROP LOSS DUE TO DROUGHT FOR THE YEAR 2000-01 (RABI 2001)

After great deal of discussion, it was felt that nearly 95% of the agricultural area in the State is under irrigation and there is little likelihood of drought affecting any area of the State. Drought affects large area and not isolated pockets. The Committee was of the view that there was no need to fix fresh norms for relief for crop loss due to drought.

AGENDA ITEM NO. 30.4 USE OF REMOTE SENSING INFORMATION FOR ASSESSMENT OF DAMAGE IN THE WAKE OF NATURAL CALAMITIES.

Sh. PK Sharma, Director Remote Sensing Centre, PAU Campus Ludhiana made a detailed presentation. The Committee of officers headed by Secretary Revenue and comprising of 6 Deputy Commissioners had earlier recommended adoption of the satellite remote sensing techniques for assessment of crop loss due to floods. Sh. Sharma explained that once the village maps are digitized it would be possible to assess crop damage village-wise for the entire state. It will involve:

(a)one time expenditure of Rs. 6.63 lacs.

(b)expenditure of Rs. 4.00 lacs every year even if there are no floods.

(c)upto Rs. 13 lacs per year only if there are floods and assessment of crop loss is needed.

Secretary Revenue pointed out that Ministry of Agriculture, Government of India has been emphasizing adoption of remote sensing techniques for assessment of crop loss. The Committee of Experts headed by S. Bhagat Singh, IAS, Additional Secretary, Ministry of Agriculture had also recommended the use of remote sensing techniques for assessment of crop loss. The members were of the view that adoption of remote sensing techniques would be useful not only for assessment of crop loss but also help the Irrigation Department in planning and execution of flood protection works. The Committee authorized the Financial Commissioner Revenue to incur expenditure as indicated in item No. (a), (b), (c) above.

ITEM NO. 30.5 REQUEST FOR ALLOTMENT OF ADDITIONAL FUNDS FROM DEPUTY COMMISSIONERS FOR FLOOD PROTECTION WORKS/MEASURES.

Secretary Irrigation and Chief Engineer Drainage could not attend the meeting. The Committee felt that the request for allotment of additional funds for flood protection works received from the various districts should be discussed in the next meeting when Secretary Irrigation and Chief Engineer Drainage were present.

ITEM NO. 30.6 RELEASE OF FUNDS TO THE DEPUTY COMMISSIONERS FOR EMERGENT FLOOD PROTECTION WORKS.

The Committee granted Ex-post facto approval for allotment of Rs. 2.25 crores to the Deputy Commissioners for emergent flood protection works during the monsoon season.
